A proposta prevê que o juiz também pode oferecer dispositivo de segurança, como um aplicativo de celular ou “botão do pânico”. O dispositivo é justificado tendo em vista que a medida protetiva de urgência limita os locais que o acusado pode frequentar, com vistas a proteger a mulher.
O projeto aprovado pelos senadores altera a Lei Maria da Penha, de 2006, ao incluir o monitoramento eletrônico à lista de medidas que o juiz pode aplicar. Pela norma atual, em casos de violência doméstica e familiar, o juiz pode aplicar de imediato medidas como afastamento do lar, proibição de aproximação e contato com a vítima e o comparecimento a programas de reeducação, entre outras.
O PL 5.427/2023 é de autoria do deputado federal Gutemberg Reis (MDB-RJ). No Senado, recebeu voto favorável da relatora, senadora Leila Barros (PDT-DF).
O relator na Comissão de Direitos Humanos (CDH), senador Paulo Paim (PT-RS), alterou o texto para deixar a cargo das secretarias de Segurança Pública definir como as mulheres e a polícia serão informadas em caso de aproximação do acusado. Já a outra proposta aprovada, PL 4.781/2023, estabelece que, além de prisão, os agressores que praticaram crimes contra a mulher poderão ser punidos com perda de bens e valores de propriedade equivalentes a no mínimo R$ 500 e no máximo R$ 100 mil. O texto espera indicação de relator na Comissão de Constituição, Justiça e Cidadania (CCJ).
